पीसीएस अधिकारी ज्योति मौर्या (Jyoti Maurya) और उनके पति आलोक मौर्या के विवाद में हर रोज नए तथ्य सामने आ रहे हैं। ऐसे ऑडियो क्लिप भी सामने आ चुके हैं जिसमें कथित तौर पर ज्योति मौर्या अपने पति आलोक से छुटकारा पाने के लिए बेहद आपत्तिजनक गैर कानूनी रास्ता अपनाने की बात कहते हुए सुनी जा रही हैं। इस ऑडियो में बोल रही महिला ज्योति मौर्या हैं या कोई और, इसकी पुष्टि होना बाकी है। लेकिन इस मामले के साथ ही यह बहस तेज हो गई है कि इस तरह के विवादों का सम्मानजनक अंत क्या होना चाहिए?
ध्यान देने की बात है कि उत्तराखंड में समान नागरिक संहिता (UCC) का ड्राफ्ट बनाने वाली कमेटी को हर धर्म, जाति और हर लिंग के लोगों से तलाक कानूनों को सरल बनाने के सुझाव मिले हैं। यानी हर वर्ग के लोग यह मानते हैं कि देश में तलाक कानून बेहद जटिल हैं। यदि किसी कारण से विवाह को आगे जारी रखना संभव न हो तो तलाक मिलना मुश्किल हो जाता है। यदि एक पक्ष तलाक न देना चाहे तो ऐसी स्थिति में विवाह से छुटकारा पाना लगभग असंभव हो जाता है। ऐसे में कई बार लोग अपने साथी से छुटकारा पाने के लिए गैर कानूनी रास्ते तक अपनाने लगते हैं। लोगों की राय है कि इन परिस्थितियों को देखते हुए तलाक कानूनों को आसान बनाया जाना चाहिए।
क्या है कठिनाई
सर्वोच्च न्यायालय के वरिष्ठ वकील अश्विनी कुमार दुबे ने अमर उजाला से कहा कि भारतीय सनातन संस्कृति में विवाह को सात जन्मों के बंधन के तौर पर देखा जाता है। हमारे समाज में उसी जोड़े को सम्मान की दृष्टि से देखा जाता है जो अपने पति-पत्नी के प्रति समर्पित हो और आजीवन उसका साथ निभाने की सोच रखता हो। यही कारण है कि विवाह के बाद किसी कारण से संबंध खराब हो जाने के बाद भी लोग सामाजिक अपयश के डर से अपने साथी को तलाक देना उचित नहीं समझते।
पहले सामाजिक-पारिवारिक दबावों के कारण विपरीत परिस्थितियों में भी लोग ऐसे वैवाहिक संबंधों को जीवन भर निभा ले जाते थे। महिलाओं की अपने पतियों पर बहुत ज्यादा आर्थिक निर्भरता के कारण भी इस तरह के संबंध मजबूरी में चलते रहते थे। लेकिन देश-दुनिया के बदलते आर्थिक परिवेश में अब सामाजिक संबंध और उनके दबाव कमजोर पड़ने लगे हैं। यही कारण है कि आर्थिक तौर पर मजबूत पति-पत्नी अब ऐसे संबंधों को निभाने के लिए तैयार नहीं हैं जो उनकी राह में रोड़ा दिखाई पड़ते हैं।
क्या हो सही अंत
अश्विनी कुमार दुबे ने कहा कि अदालतें इस तरह के मामलों का निपटारा करते समय सबसे पहले सुलह कराने के प्रयास करती हैं। मध्यस्थता केंद्रों या मैरिज काउंसलर (वैवाहिक मामलों के सलाहकार) की सहायता से पति-पत्नी में एक समाधान तक पहुंचने की कोशिश की जाती है। यदि संबंध किसी भी कीमत पर साथ चलने योग्य न रह गए हों तो दोनों पक्षों की आर्थिक स्थिति देखते हुए उनके आगामी भविष्य को सुरक्षित रखते हुए तलाक की प्रक्रिया आगे बढ़ा दी जाती है। इस पूरी प्रक्रिया में अदालत सबसे पहले बच्चों का जीवन सुरक्षित बनाने की कोशिश करती हैं जो अपने भविष्य के लिए मां-बाप दोनों पर निर्भर करते हैं, लेकिन भावनात्मक सहारे को ध्यान में रखते हुए इस तरह के मामलों में बच्चों की कस्टडी ज्यादातर मां को मिल जाती है।
हालांकि, व्यावहारिक तौर पर सच्चाई यह है कि कई बार महिलाएं इन अधिकारों का दुरुपयोग करती हैं और बच्चे की शिक्षा-पालन पोषण के नाम पर पति से ज्यादा से ज्यादा पैसा वसूलने की कोशिश करती हैं। इन्हीं मामलों की उलझन में तलाक के मामले कई दशकों तक चलते रह जाते हैं।
कैसे आसान हो सकती है तलाक प्रक्रिया
अश्विनी कुमार दुबे ने कहा कि सबसे पहले तो हमें यह सच स्वीकार करना चाहिए कि हमारा सामाजिक-आर्थिक परिदृश्य तेजी से बदल रहा है। ऐसे में हमारे संबंधों में भी बड़ा बदलाव देखने को मिल रहा है। तलाक को एक सामाजिक कलंक के रूप में नहीं देखा जाना चाहिए। हमें यह स्वीकार करना चाहिए कि तलाक केवल किसी बुरे पति-पत्नी से छुटकारा पाने का मामला नहीं है।
कई बार दो अच्छे लोगों का भी वैचारिक मतभेद के कारण साथ रहना संभव नहीं रह जाता। पुरुषों-महिलाओं में शिक्षा बढ़ने के कारण अब वे अपने स्वतंत्र अस्तित्व को ज्यादा महत्त्व देने लगे हैं और उसका सम्मान किया जाना चाहिए। केवल सामाजिक टैबू के डर से किसी पति-पत्नी को साथ रहने के लिए मजबूर नहीं किया जाना चाहिए।
कई देशों में विवाह पूर्व पति-पत्नी के बीच एक करार होता है। इसमें किसी कारण विवाह संबंध कायम न रह पाने की स्थिति में पति को अपनी पत्नी को उस निश्चित धन को चुकाना होता है। इस्लाम में मेहर की रकम इसी प्रथा का प्रतिनिधित्व करती है। इसी प्रकार कई पश्चिमी देशों में विवाह संबंध कायम न रह पाने की स्थिति में पति-पत्नी की संपत्ति को एक साथ रखकर उसका दोनों के बीच बराबर-बराबर बंटवारा कर दिया जाता है।
उन्होंने कहा कि पति-पत्नी अब एक समानता की ओर बढ़ रहे हैं। शिक्षा, कमाई और आर्थिक सुरक्षा के मामलों में दोनों एक समान हो रहे हैं। ऐसे में अब जेंडर जस्टिस यानी हर लिंग के व्यक्ति के लिए एक कानून बनाने की बात की जा रही है। ये बदलाव तलाक कानूनों में भी लाया जाना चाहिए जहां पति-पत्नी कोई भी एक-दूसरे का शोषण न कर सके और साथ न निभ सकने वाले संबंधों में दोनों को अलगाव की आसान व्यवस्था उपलब्ध होनी चाहिए।
